「原発メーカー訴訟の会」の「私たちの主張」を書き改めました。また英訳も同時並行で完成させました。東京で翻訳したものをブラジルでnative checkしてもらいました。作業に関わってくださった方には心から感謝申し上げます。どうぞ、この文書が世界中で私のブログをご覧いただいている方から、またその国・地方で拡散して下さることを願ってやみません。私たちが原発メーカーの責任を問う裁判をと東京地裁で進めていますが、これは原発の製造・輸出運動につながることを願ってはじめたものです。国際的な連帯を広げていきたいものです。明日から、広島で開催される「核のない未来を！世界被爆者フォーラム」に参加し、配布します。

― いかなる差別も、核兵器も、原発もない社会をめざして ━

私たち「原発メーカー訴訟の会・本人訴訟団」は福島第一原発の事故で何一つ責任を取らない原発メーカー３社（GE・東芝・日立）を被告として、原発の製造と輸出は違法行為（民法９０条　「公序良俗」）であり、断じて許せないということを裁判で訴えています。

裁判では原発メーカーに「精神的損害」の賠償を請求するという形になりますが、真の目的は原発の製造・輸出をやめさせることです。

原発は核兵器と表裏一体のものです。「原子力の平和利用」そのものが超大国の核による世界支配体制を補完するものであり、人間・民族・国家間を差別する構造の上に成り立つ、きわめて非人間的なものなのです。国内外の差別を私たちは植民地主義であると定義します。その植民地主義を正当化する装置が国民国家であり、原発体制は原理的に植民地主義によって成り立っている政治システムではないでしょうか。従って、原発体制との闘いは国民国家の枠を超えることによって可能になります。その闘いは一国平和主義を乗り越え、国際連帯運動によって実現されるものと信じます。

原発体制を支える差別は、ウランを採掘する被曝労働から始まり、原子炉の中で働き被曝せざるをえない原発労働者（そのほとんどが下請け・孫請け・ひ孫請け労働者）の存在、都会に電力を供給するために原発立地地域になった地方と都会の搾取・差別の構造、核を持つ国と持たざる国との差別のうえで成り立つNPT（核不拡散条約）体制の存在に示されています。さらに、NPT体制は核兵器の縮小を議論しながら原発を輸出し拡散することを認めています。

福島での悲惨な事故を起こしながら、原発メーカー（上記３社に加えて三菱も）はその責任を感じて謝罪するどころか、政府と手を組んで、アジア各国やリトアニアなど世界中に原発を輸出しようとしています。一方、政府は核廃棄物の投棄場を国内の貧困地域に押し付けようとしていますが、それが困難になった場合に備えて、モンゴルのウラン採掘に積極的に投資しながら（三菱グループ）、核廃棄物をモンゴルに持込み砂漠に埋蔵する秘密契約をアメリカ・モンゴル政府と締結しています（「核処分場：モンゴルに建設計画　日米、昨秋から交渉　原発ビジネス拡大狙い」（毎日新聞 2011年5月9日）。

日本だけではありません。世界中の人々は原発建設の反対運動に立ち上がっています。私たちは裁判で原発メーカーの原発製造や輸出をやめさせることを目指すとともに、海外で原発に反対している人々と連帯して、世界から原発と核兵器、そしていかなる差別をもなくしていく運動を進めていきます。

What We the “Principal Litigation Team in the Class Action against Nuclear Reactor Builders Demand:

― Seeking a Society without Discrimination, Nuclear Weapons, or Nuclear Power Plants ―

    We, the “Principal Litigation Team in the Class Action against Nuclear Reactor Builders,” are taking legal action, against the three nuclear reactor builders who refuse to bear any responsibility in the Fukushima Daiichi Nuclear Power Plant disaster, naming General Electric Company in Japan, Toshiba Corporation, and Hitachi, Ltd. as the Defendants We assert that the production and exporting of nuclear power plants and nuclear reactors constitute illegal activity, according to the Civil Code Article 90 (which prescribes “Public Order and Morals”), and are therefore absolutely impermissible.

    In the trial, we claim compensatory damages against these nuclear reactor builders for “emotional distress.”  But our true objective is to halt the production and exports of nuclear power plants and reactors by the nuclear reactor builders.

    Nuclear power generation and nuclear weapons are two sides of the same coin.  The so-called “peaceful use of nuclear power generation” itself complements the superpowers’ regime of world domination by nuclear weapons. What is more, nuclear power generation is extremely inhumane because it exists upon a structure that discriminates among peoples, ethnicities, and states. We define this discrimination both within and without one’s country, as colonialism. Furthermore, we believe that the nation-state is the device that justifies such colonialism, and that the nuclear regime is a political system that is fundamentally established by colonialism. Accordingly, the battle against the nuclear regime is made possible by transcending conventional boundaries of the nation-state. Victory of this battle will be feasible by going beyond individual states’ pacifist ideologies and achieving an international movement of solidarity.

    The discrimination that supports the global nuclear regime is pervasive in all levels of nuclear production, from radiation-exposed labor that exploits people in uranium mining, to nuclear plant workers (the majority of whom are hired by sub-contractors or their sub-contractors or their sub-contractors) who are put to work within the actual reactors and thus cannot avoid radiation exposure, to the method of development of provincial areas that are selected to host nuclear power plants that supply energy to the main cities (the structure of exploitation & discrimination against rural areas by the big cities), to the existence of the Nuclear Non-Proliferation Treaty regime that segregates the haves and have-nots.  In fact, the NPT regime admits to discussing the reduction of nuclear weapons while exporting and proliferating nuclear power plants.

    Far from taking responsibility and apologizing for the devastation they caused in Fukushima, the nuclear reactor builders (the above three defendants as well as the Mitsubishi Companies) are trying to export their nuclear wares to various Asian countries as well as East Europe (e.g. Lithuania), with the Japanese government’s cooperation.  Meanwhile, the Japanese government is attempting to force poorer regional governments in Japan to accept building nuclear waste repositories.  At the same time, in preparation for significant opposition from the local residents, it has forged secret treaties with the American and Mongolian governments to invest actively in Mongolia’s uranium mining (cooperating with Mitsubishi) while smuggling its nuclear waste into Mongolian to be buried in the desert.  (Mainichi Newspaper, May 9, 2011: “Japan & US have been negotiating since last autumn for building nuclear waste repository in Mongolia, aiming for enhancing nuclear business”). 

    We Japanese are not alone in our protest. People all over the world are standing up against the construction of nuclear power plants. As we aim in taking legal action in court to stop the production and the export of nuclear power plants by nuclear reactor builders in Japan, we also seek to stand in solidarity with the people of the world who oppose nuclear power and to campaign for the elimination of nuclear power plants, nuclear weapons, and all forms of discrimination.
